Determination of Compensability

Claim compensability is determined by applying the facts obtained during our investigation to the workers' compensation statute and supporting regulations. In the event that a claim is determined to be non-compensable, we immediately issue a request for claim denial to the Department of Labor and industries after conferencing with our client. Should additional time be required to complete the claim investigation process, a request is made to the Department of Labor and industries for an interlocutory order. We inform the worker of this action and his or her rights should he or she wish to protest the claims rejection.
